Terms of Service

Plain language summary: You sign up for one of three tiers and pay monthly or annually. Each week we generate social posts for you based on what you tell us. You approve, edit, or reject each post before it publishes. We publish approved posts directly to your connected accounts (Instagram, Facebook, X, LinkedIn, Threads). You own everything we make for you. You can cancel any time.

1. The agreement

These Terms govern your use of RootedPost, a product of Watchlight Interactive LLC (a Wisconsin limited liability company). By signing up or using the service, you agree to these Terms and our Privacy Policy.

We offer three tiers — Starter, Growth, and Pro — billed monthly or annually. Current pricing is shown on our pricing page. Subscriptions auto-renew at the start of each billing period until canceled.

5. Cancellation

You can cancel anytime from the customer portal (or by emailing support@watchlightinteractive.com). Your service continues through the end of the billing period you paid for; we won't bill you again. We can also terminate your account if you violate these Terms — with reasonable notice unless the violation is severe or imminent harm (e.g. policy abuse causing platform suspension).

6. Content ownership

You own all content we generate for your business — post copy, hashtags, and AI-generated images. You grant us a limited, non-exclusive license to display, edit, transmit, and publish that content as needed to operate the service (e.g. show it in your approval dashboard, send it to platform APIs for publishing on your behalf).

You retain full ownership of any materials you provide (your own photos, logos, brand voice descriptions, intake notes). You grant us a limited license to use them solely to operate the service for you.

We may use anonymized, aggregated metadata (e.g. "the average post takes N words") internally to improve the service. We do not use the substance of your posts, your brand profile, or any identifiable information to train AI models or for any other use outside delivering the service to you.

7. AI-generated content

Posts are drafted using OpenAI's models. We make no guarantee that any individual post is original, factually accurate, or appropriate for your business — which is why every post requires your approval. If something is wrong, edit it, reject it (with a note — we'll regenerate), or skip the week. Once you approve a post, you affirm that the content is accurate and you have the right to publish it. We are not liable for the consequences of publishing AI-drafted content you approved. Because you approve every post before it publishes, you are responsible for the content you choose to publish, and the indemnification in Section 11 applies to that content.

8. Connected platforms

You connect your own social accounts (Instagram, Facebook, X, LinkedIn, Threads) via each platform's standard OAuth flow. You may disconnect any platform at any time from your dashboard or by revoking access on that platform directly.

We are not responsible for the availability, behavior, or policy decisions of those platforms. If a platform removes a post, suspends your account, changes its API rules, or changes its terms, we will do our best to adapt — but we cannot guarantee uninterrupted publishing. We will surface any platform error we encounter so you can take corrective action (e.g. reconnect when a token expires, edit a post that violates a platform rule).

9. Service availability

We aim for high availability but do not guarantee 100% uptime. Scheduled maintenance, third-party outages, and other interruptions may occur. If the service is materially unavailable for an extended period (we'd consider 72 continuous hours material), contact us and we'll work out a fair adjustment to your bill.

10. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to defend, indemnify, and hold harmless Watchlight Interactive LLC, its owners, employees, and contractors (the "Indemnified Parties") from and against any third-party claims, demands, suits, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) content you submitted, approved, edited, or published through the service, including any claim that such content is defamatory, false, misleading, infringing, or violates any law or any platform's rules; (b) materials you provided to us (including photos, logos, brand descriptions, and intake notes) and your representation that you hold the necessary rights to them; (c) your use of the service in violation of these Terms or applicable law; or (d) your authorization for us to access and publish to a social media account you do not own or are not authorized to manage.

We will notify you of any claim subject to this section, and you may control the defense with counsel of your choosing, provided that we may participate with our own counsel at our expense and that you may not settle any claim in a way that imposes obligations or admissions on an Indemnified Party without our prior written consent. This section survives termination of these Terms.

12. Limitation of liability

To the maximum extent permitted by law, Watchlight Interactive LLC's total liability under these Terms is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

13. Changes to these Terms

We may update these Terms from time to time. If the changes are material, we'll email you at least 14 days before they take effect. Continued use after that constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law principles. Any disputes are resolved in the state or federal courts located in Dane County, Wisconsin.
